Agreement to these Terms
These Terms of Service govern access to Nexivo VPN websites, accounts, VPN connectivity and related services. By creating an account, purchasing or using a service, you agree to these Terms and our Acceptable Use Policy and acknowledge our Privacy Policy.
If you use Nexivo on behalf of an organisation, you confirm that you have authority to bind that organisation.
The Nexivo service
Nexivo provides managed VPN connectivity and related account, device, configuration and infrastructure-management features. Features, locations, capacity and supported platforms may change as the service develops.
We may carry out maintenance, replace or relocate infrastructure, change routes or temporarily restrict a service where reasonably necessary for security, stability, legal compliance or network management.
Accounts and security
- You must provide accurate information where it is required to operate your account.
- You are responsible for protecting passwords, VPN configurations, private keys and other credentials issued to you.
- Do not share credentials beyond the users or devices permitted by your plan.
- Tell us promptly if you believe an account, device profile or VPN key has been compromised.
We may require credential resets, revoke VPN profiles or temporarily restrict access where we reasonably believe an account is compromised.
Acceptable use
You must use Nexivo lawfully and in accordance with our Acceptable Use Policy. Prohibited activity includes attacks, unauthorised access, malware distribution, fraud, unlawful content distribution and deliberate interference with networks or services.
We may suspend or terminate access where reasonably necessary to protect the service, other users, third parties or Nexivo infrastructure, or where there is a serious or repeated breach.
Plans, limits and fair use
Plans may include limits on devices, users, locations, bandwidth, concurrent connections or other resources. Current plan details presented at purchase form part of your service agreement.
Where a service is described as unlimited, it remains subject to reasonable technical capacity, lawful use and the AUP. We may contact customers whose use materially disrupts service for others or indicates abuse.
Charges, billing and cancellation
Pricing, billing periods, taxes and renewal terms will be shown before purchase. Unless stated otherwise at purchase, recurring services may continue until cancelled in accordance with the applicable plan terms.
Any statutory cancellation or refund rights that apply to consumers are not excluded by these Terms. Additional refund or cancellation rules may be displayed with a particular product or order.
We may suspend a paid service where an amount remains overdue after reasonable notice, subject to applicable law.
Availability and changes
We aim to provide a reliable service, but VPN connectivity can be affected by maintenance, upstream providers, internet routing, local networks, device configuration, blocking by third-party services and events outside our reasonable control. We do not guarantee uninterrupted availability or that every website or third-party service will accept connections from every VPN address.
Privacy and network data
Our handling of personal information is described in the Privacy Policy. Nexivo may process limited account, connection, operational and security information required to provide, protect and troubleshoot the service. We do not promise that use of a VPN makes a user anonymous or immune from lawful investigation.
Intellectual property
Nexivo branding, website materials, software, interfaces and documentation are owned by or licensed to Nexivo/RnG Group and are protected by applicable intellectual-property laws. Your subscription gives you a limited right to use the service; it does not transfer ownership of our software, branding or systems.
Liability
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or applicable statutory consumer rights.
Subject to those rights, Nexivo is not responsible for losses caused by misuse of the service, compromised user credentials, third-party websites or services, local network failures, or events outside our reasonable control. Business customers should maintain appropriate backups, security controls and business-continuity arrangements.
Suspension and termination
You may stop using Nexivo and cancel services in accordance with your plan. We may suspend or terminate service for material or repeated breach, non-payment, security threats, unlawful use, or where continuing to provide the service would expose Nexivo or others to material legal or technical risk.
Where appropriate, we will try to provide notice and an opportunity to resolve an issue, but urgent action may be taken without advance notice where necessary to contain abuse, compromise or serious harm.
Governing law
These Terms are governed by the laws of England and Wales, except where mandatory consumer law gives you rights under another applicable jurisdiction. Courts with jurisdiction under applicable law may hear disputes.
